Terms of Service

These Terms of Service (“Terms”) govern your access to and use of redhorsesystems.com and the RedHorse CRM and RedHorse Business Manager software and related services (together, the “Services”), provided by RedHorse Systems (“RedHorse,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms.

1. Use of the Services

You must be at least 18 years old and able to form a binding contract to use the Services. You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

2. Accounts and subscriptions

Certain features of the Services require a paid subscription or license. Fees, billing cycles, and payment terms will be provided at the time of purchase or in a separate order form or agreement. Unless stated otherwise, fees are non-refundable.

3. Customer data

If you use RedHorse CRM or RedHorse Business Manager, you retain all rights to the data you or your organization input into the Services (“Customer Data”). You grant RedHorse a limited license to host, process, and use Customer Data solely to provide, maintain, and support the Services. You are responsible for the accuracy, quality, and legality of your Customer Data and for obtaining any necessary rights and consents to submit it.

4. Acceptable use

You agree not to: reverse engineer or attempt to extract the source code of the Services except as permitted by law; interfere with or disrupt the integrity or performance of the Services; use the Services to store or transmit infringing, defamatory, or unlawful material; or attempt to gain unauthorized access to the Services or related systems.

5. Intellectual property

The Services, including all software, text, graphics, logos, and other content (excluding Customer Data), are owned by RedHorse or its licensors and are protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Services other than the limited right to use them as permitted.

6. Third-party integrations

The Services may integrate with third-party products such as Outlook, Gmail, QuickBooks, and Constant Contact. Your use of those third-party products is governed by their own terms, and RedHorse is not responsible for the availability, accuracy, or practices of third-party services.

7. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. RedHorse does not warrant that the Services will be uninterrupted, error-free, or completely secure.

8. Limitation of liability

To the maximum extent permitted by law, RedHorse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services, even if advised of the possibility of such damages.

9. Termination

We may suspend or terminate your access to the Services at any time for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties. You may cancel your subscription at any time in accordance with your order form or account settings.

10. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the effective date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
